Web Services User Agreement

Please read this Web Services User Agreement ("Terms") carefully before using the Web Services. By accessing and/or using the Web Services, you agree to these Terms. PLEASE DO NOT USE THE WEB SERVICES IF YOU DO NOT AGREE WITH THESE TERMS. In these Terms, Continent Worldwide Hotels ("CWH") and its subsidiaries may be referred to collectively as "Continent," "we," "us" or "our." These Terms constitute a contractual agreement between you and CWH regarding your use of the services covered by these Terms.

Coverage

This Web Services Terms of Use applies to our Loyalty Program and each of the following brands: Continent Hotels & Resorts, Ancyra Hotels & Inns, Lofty Collection by Continent, UpTown Hotels | Inns | Suites, The Park Square Hotels, Budgetel Inn & Suites, Easy Hotel Franchise, Continent Franchise Services, People Fine Dining, Loona Club, People Club. The Web Services include our websites, mobile websites and other Internet-enabled means by which we provide content to you or receive content from you.

Important notice — Arbitration & Class Action Waiver

These Terms contain certain Disclaimers and Limitations on our Liability, and a binding Arbitration Clause and Class Action Waiver, which waives your right to sue in court or seek a jury trial for disputes relating to your use of the Web Services.

Changes to the Terms

We may update and amend these Terms from time-to-time. All changes are effective immediately when we post them and apply to all access to and use of the Web Services thereafter. However, any changes to the Arbitration and Governing Law sections will not apply to any disputes for which the parties have actual notice on or before the date the change is posted.

Privacy

By using any of the Web Services, you hereby agree to the terms of our Privacy Notice.

Links to third-party sites

The Web Services may permit you to link to other websites or applications that may or may not be affiliated with us. Your access to and use of such linked third-party websites are governed by their own terms of use and policies.

Intellectual property

All content available through the Web Services — text, images, illustrations, graphics, logos, digital downloads, data, software, headers, icons, scripts, audio and video clips — is our or our Providers' property, and is protected by copyrights, trademarks and other intellectual property rights. You may not copy, reproduce, republish, upload, post, transmit, distribute or exploit the Content for commercial use without our prior written consent.

User responsibilities

You warrant that you will not use the Web Services for any purpose that is unlawful, illegal or prohibited by these Terms. If you violate these Terms, your permission to use the Web Services immediately terminates. You are solely responsible for the content, accuracy and use of your User Information.

Prohibited activities

You are prohibited from: overloading our infrastructure or sending spam; disclosing your login credentials; probing our security; reverse-engineering the software; interfering with or damaging our systems; uploading content you don't have a right to transmit; violating any applicable law; using any robot, spider or automatic device to scrape the Web Services without permission.

Disclaimer of warranties & limitation of liability

The materials on the Web Services are provided "AS IS" and "AS AVAILABLE" without warranty of any kind. Continent Worldwide Hotels, its subsidiaries, affiliates, officers, directors, employees and agents shall not be liable for damages or losses of any kind arising out of or in connection with your use of the Web Services.

Governing law

We operate the Web Services from our offices within Istanbul, Turkey. These Terms and your use of the Web Services shall be governed in all respect by the internal substantive laws of Istanbul, Turkey, without regard to any conflict of laws provisions.

Most hotels are independently owned and operated

Many of our brand hotels and facilities are independently owned and operated by independent franchisees and licensees. In such cases, these franchisees manage and operate the facilities and are the employers of all employees who work at the property.
